O male, forse? Qualcuno non si fidava che ci fosse davvero un simile provvedimento, e ha voluto verificare?


io stavo scorrendo velocemente e premesse iniziali e devo dire di avere trovato la premessa al punto 58) illuminante e fondamentale, la riporto qui sotto:

E' necessario che il valore atteso delle passività assicurative sia calcolato sulla base di informazioni attuali e credibili e di ipotesi realistiche, tenuto conto delle garanzie finanziarie e delle opzioni previste dai contratti di assicurazione e riassicurazione, in modo tale da poter fornire una valutazione economica delle obbligazioni di assicurazione o di riassicurazione. E' opportuno prescrivere l'uso di metodologie attuariali efficaci ed armonizzate.

Mi sembra una considerazione valida ed importante soprattutto la chiosa finale relativa all'uso di metodologie attuariali efficaci ed armonizate.

Già.
Pensare che Solvency I (che è ancora in vigore, santo cielo!) teneva conto, secondo la leggenda, unicamente di serie storiche di un solo Paese europeo, e solo dei rischi tecnici, fa venire i brividi. Condividi con me questo pensiero?

Secondo me, in un serio forum di finanza, uno dei primi temi da affrontare nel dibattito su Solvency II dovrebbe essere quello della potenziale prociclicità delle misure di vigilanza.

Vado a studiarmi un paio di articoli e poi dò un parere sul confronto con il precedente, (ma ancora in vigore :wall::wall::wall: ) Solvency I per valutare le enormi migliorie portate dal nuovo documento approvato postato da Ignatius.

Notavo ad esempio che con la nuova normativa gli stati membri debbono prescrivere alle autorità di vigilanza di fornire annualmente alcune informazioni al CEIOPS.
Tra tali informazioni troviamo:
- la maggiorazione media del capitale per impresa e la distribuzione delle maggiorazioni del capitale imposte dall'autorità di vigilanza durante l'anno precedente, misurata in percentuale del requisito patrimoniale di solvibilità.

SCR.2.3. Calculation of the adjustment for loss absorbency of technical provisions and deferred taxes
SCR.2.6. The adjustment for the loss-absorbency of technical provisions and deferred taxes reflects the potential compensation of unexpected losses through a decrease in technical provisions or deferred taxes. In relation to technical provisions the adjustment takes account of the risk mitigating effect provided by future discretionary benefits to the extent undertakings can establish that a reduction in such benefits may be used to cover unexpected losses when they arrive.​

SCR.2.7. In QIS5 the following two approaches for the calculation of the adjustment for the
loss-absorbency of technical provisions and deferred taxes are tested:
• the equivalent scenario; and​
• the modular approach.

SCR.2.8.Undertakings are expected to carry out the calculation of the adjustment according to both approaches.
This will allow stakeholders and the political level
to compare both approaches and decide on the approach that should be adopted under Solvency II. The double calculation is only required for the adjustment itself.
For calculations that depend of the SCR (like the risk margin or the eligible own funds) the result of the equivalent scenario should be used.

SCR.2.15. For the purpose of this calculation, the value of deferred taxes should be calculated as set out in the section on valuation. Where a loss of [FONT=TimesNewRoman,Italic]SCRshock [/FONT]would result in the setting up of deferred tax assets, insurance and reinsurance undertakings should take into account the magnitude of the loss and its impact on the undertaking's financial situation when assessing whether the realisation of that deferred tax asset is probable within a reasonable timeframe.
SCR.2.16. For the purpose of this calculation, a decrease in deferred tax liabilities or an increase in deferred tax assets should result in a negative adjustment for the lossabsorbing capacity of deferred taxes.
SCR.2.17. Where it is necessary to allocate the loss [FONT=TimesNewRoman,Italic]SCRshock [/FONT]to its causes in order to calculate the adjustment for the loss-absorbing capacity of deferred taxes, the equivalent scenario can be used for this purpose.

SCR.2.18. To facilitate the testing of the single equivalent scenario, CEIOPS provides a spreadsheet which determines the single equivalent scenario for each undertaking.

The allocation should be consistent with the contribution of the modules and submodules of the standard formula to the Basic SCR.

Osservo che la norma sembra un'applicazione al contrario di un principio di buon senso.
Per questo penso di aver capito male, e chiedo alle illuminate menti di InvestireOggi, sezione Isola dei Forumers, di chiarire dove sbaglio.

Ad esempio: immaginiamo un BSCR (patrimonio minimo di vigilanza) di 100 milioni di euro (lasciamo perdere, per semplicità, l'aggiustamento per le capacità di assorbimento perdite delle riserve e il rischio operativo).

SCRshock = BSCR + AdjTP + SCROp, quindi SCRshock sarebbe pari a 100 milioni

Immaginiamo un'aliquota fiscale media del 30%: una perdita di 100 milioni comporterebbe, in teoria, un beneficio fiscale di 30 milioni

Quindi, il mio ragionamento è: se sono certo di poter recuperare le perdite fiscali, e la mia perdita (lorda) massima attesa è di 100 milioni, dovrebbe risultare che la mia perdita massima attesa (netta) dovrebbe essere di 100-30=70 milioni.

Invece, SCR = BSCR + Adj +SCROp: quindi parrebbe che, se io rischio di perdere 100 milioni, devo disporre di un patrimonio di vigilanza di 130 milioni (assurdo!).

Per fortuna le Errata Corrige alle istruzioni specificano
The adjustment for loss absorbency of technical provisions and deferred taxes should not be positive (nel testo originario c'era scritto negative).

Quindi, l'interpretazione di buon senso dovrebbe essere corretta: il beneficio fiscale sulle perdite dovrebbe essere negativo, quindi riduce l'SCR.

Ma perché scrivere in modo così "contro-intuitivo" le regole?


PS Il mio SCR è zero perché sono già fallito.
