Lehman Throws Support Behind RMBS Settlement

July 3, 2017

Lehman Brothers Holdings Inc. urged a New York bankruptcy court on Friday to approve a grand bargain to end claims over billions of dollars' worth of dud financial-crisis-era mortgage-backed securities that it sold to investors who were left holding them after the bank's failure.

If a judge approves the motion at a hearing on Thursday, it will yield a multiweek estimation proceeding in coming months that will resolve billions of dollars' worth of claims for repurchase of MBS that lost value in the financial crisis.

Onestamente non sono in grado allo stato attuale di comprendere se e quanto noi, obbligazionisti LBHI/LBT, potremo trarre beneficio dalla notizia sopra riportata.

Intanto prendiamo atto che un altro filone della intricata vicenda dovrà essere trattato in tribunale nelle prossime settimane se il giudice riterrà ammissibile la questione in oggetto.

Intanto prendiamo atto che un altro filone della intricata vicenda dovrà essere trattato in tribunale nelle prossime settimane se il giudice riterrà ammissibile la questione in oggetto.

E' da tempo che aspetto la conclusione dell'unwinding del matassone dei claims. Solo sapendo l'ammontare dei claims riconosciuti come legittimi ci si potrebbe fare un'idea più precisa dell'entità del recupero finale.

RMBS trustees accept $2.4 billion toxic mortgage settlement from Lehman Brothers
BlackRock, Goldman Sachs among institutional investors in settlement

The trustees in a series of residential mortgage-backed securities trusts reached a settlement with the remains of Lehman Brothers Holdings that could be worth more than $2.4 billion over claims that the RMBS deals contained toxic mortgages.

Robert Madden, an attorney with Gibbs & Bruns, which represented the institutional investors, said that that the settlement is “an important step in finally resolving the Lehman RMBS claims, and obtaining value for certificateholders in the trusts.”

All in all, the trustees for 238 RMBS trusts accepted a settlement that establishes a minimum payout of $2.4 billion.

The trustees involved in the settlement are Deutsche Bank National Trust Company, TMI Trust Company, U.S. Bank National Association, and
Wilmington Trust Company.

Also included in the settlement are 14 institutional investors, including: AEGON USA Investment Management, BlackRock Financial Management, Cascade Investment, the Federal Home Loan Bank of Atlanta, Goldman Sachs Asset Management, Invesco Advisers, Kore Advisors, Metropolitan Life Insurance Company, Pacific Investment Management Company, Sealink Designated Activity Company, The TCW Group, Thrivent Financial for Lutherans, Voya Investment Management, and Western Asset Management Company.

Mi è stato chiesto in privato, riconfermo in pubblico:

le Classi 3 e 5, secondo le sacre scritture, devono essere " satisfied in full ", non " paid full ".

Ciò vuol dire che devono essere soddisfatte fino a quando ci saranno eventuali liquidità di cassa, ma non che debbano essere pagate totalmente.

Come è facilmente comprensibile, la differenza non è di poco conto!
