Sta di fatto che questa distribuzione presenta molte anomalie.

Sicuramente il tutto è condizionato dalla distribuzione finale per LBT dei primi di Maggio.

Allora siamo d'accordo nell'interpretazione. Come ho scritto in precedenza, se serve (per l'avanzamento del processo) sborsare miliardi per la liquidazione di una succursale è ovvio che nell'immediato il gettito per i rimborsi si assottilia parecchio. Presumo e spero che questo assottiliamento sia una tantum.

Il fatto e' che, come in ogni cosa, i fregati siamo tutti e riescono a fare figli e figliastri.
Ma cosi' va' il mondo e la vita. Me ne faro' una ragione, tanto non c'e' rimedio.
Comunque, da come si pensava potessero andare le cose appena c'era stato il fallimento, nessuno si puo' lamentere, neppure i possessori di LBHI come me

La Audiencia de Barcelona ha dictaminado que la venta se realizó a clientes no especialistas

Barcelona, 09 de abril de 2019

La Audiencia de Barcelona ha anulado la compraventa de bonos de Lehman Brothers Treasury CO BV que comercializó Banc Sabadell a clientes no especialistas. La justicia asegura que el banco no ha justificado el haber proporcionado la información necesaria sobre las consecuencias y riesgos que tenía efectuar esta operación.

De esta forma, la justicia catalana estima un recurso que presentó la Asociación de Defensa de Usuarios de Bancos, Cajas y Seguros (ADICAE). Esta señaló a través de un recurso que en esta operación de compraventa se había cometido una valoración probatoria y jurídica errónea. Además, afirmaba la asociación, se incumplían varias de las obligaciones contractuales.

Adicae ya había presentado una primera demanda contra el Sabadell sobre esta operación de compraventa, pero fue desestimada por un juzgado de primera instancia de Barcelona. Ahora, la Audiencia Provincial ha acceptado el recurso.

La Audiencia cree que tuvo lugar un "error vicio invalidante del consentimiento", ya que no se dio la información "detallada, clara e inclusiva", necesaria para entender la contratación del producto, que además, se ofertaba a unos clientes que no eran especialistas.

En consecuencia, la entidad bancaria deberá abonar la suma correspondiente al precio de compra de los bonos más los intereses legales que se les aplican desde la fecha de adquisición. Se restarán de esa suma las cantidades recuperados y rendimientos percibidos de los bonos; y se sumarán los costes generados durante el proceso.

Non seguo in modo specifico quanto di tuo interesse.

A mio giudizio, per quello che può valere, la vedo molto difficile dato che i creditori spingono per vendere tutti gli asset residui e distribuire i relativi importi.

Se ne desume che, fino a quando i titolari di obbligazioni LBHI non saranno totalmente soddisfatti, niente o poco rimanga per poter pensare ad un intervento sui possessori di azioni.

Rigorosamente IMHO!!!
