Lehman Brothers Treasury: Clarification regarding eligibility of noteholders to participate in consent solicitation and to receive substitute notes
Amsterdam, The Netherlands – 13 February 2019

Further to the consent solicitation launched by Lehman Brothers Treasury Co. B.V. in liquidation (“LBT”) on 24 January 2019 in connection with its partial wind-down, and following questions received from market participants regarding the eligibility of noteholders to participate in the consent solicitation, LBT wishes to clarify, for the avoidance of doubt, that only Qualified Noteholders (as such term is defined on page 11 of the Information Notice published on LBT’s website at www.lehmanbrotherstreasury.com) may receive substitute notes.

All other noteholders (including retail investors) will automatically receive a final cash distribution from LBT without any further action being required.

Any questions by noteholders, who are not Qualified Noteholders, or their custodians may be directed to LBT:

Ieri sera ho parlato con New York, come vi avevo promesso.

Ho sottolineato le difficoltà interpretative evidenziate anche con voi, su questo forum, circa l'ambito di applicazione del cambio proposto dalla procedura fallimentare olandese. Dubbi e difficoltà ampliate dall'ultimo report contenente alcuni Isin, come letto nella giornata di ieri, pubblicato da Rewo, che ringrazio.

Effettivamente hanno convenuto con me sulla ambiguità della faccenda e sulla necessità di ulteriori precisazioni in merito.

Che dire: avrebbero potuto essere chiari sin dall'inizio e ci avrebbero evitato sbattimenti vari, anche se al riguardo non avevamo grandi speranze sin da subito.

Ma la certezza l'abbiamo solo adesso!!!

Confermata anche la nostra partecipazione ad eventuali future distribuzioni provenienti da LBHI.

Questo è quanto.

Quindi con il 2 Maggio 2019 possiamo dire AMEN alla procedura fallimentare olandese.

Ora tutta la nostra attenzione si rivolge alla relativa percentuale di recupero finale LBT.

Ai retail, alcune banche, non tutte a quanto pare, comunicano solo l'ultima distribuzione finale LBT, prevista per il 2 Maggio 2019.
